Sampson has five counts against him — one count of each of the following: the negligence of defendant Sampson, the negligence of defendant seduction, vicarious liability (actual agency) of defendant seduction, vicarious liability (apparent agency) of defendant seduction, and vicarious liability (employment) of defendant seduction.
During the surgery, “Sampson failed to maintain appropriate control of his cannula and/or failed to maintain knowledge of the location of the cannula tip within Erica Russell’s anatomy, resulting in repeated perforations of the abdominal wall and punctures of the liver, bladder, and/or intestines,” per the court documents.
The documents further stated that the cause of Erica Russell’s death was determined to be pulmonary fat emboli and hemoperitoneum due to liposuction and bilateral gluteal augmentation surgery.

Sampson allegedly began his workday at 6:30 a.m. the day of Russell’s surgery and performed procedures on six patients before he got to her at 8:30 p.m. that night, according to the court documents. Russell’s procedure began 14 hours into Sampson’s work day.
Russell then coded two hours later at 10:50 p.m. and died that night — allegedly 16 hours into Sampson’s work day.

Additionally, Sampson was previously restricted from performing surgeries at the Seduction Cosmetic Center Corp, per the complaint. Russell was informed that Sampson had “privileges at a local Coral Gables hospital, and it turns out he didn’t,” Levine claimed.
The court documents state that Sampson was “not approved to perform surgical procedures.” Seduction Cosmetic Center also reported to the Florida Department of Health that Sampson was a “designated physician,” and he was not performing surgery anymore, but Sampson was allegedly still performing surgeries on patients.

“Now this young woman, 33 years old, she’s dead. And her five kids are going to grow up without their mother,” says Levine. “And it’s just a really, really sad story.”
